1. Agreement and eligibility
These Terms of Use (“Terms”) form an agreement between you and Cashify, the operator of this website and device-purchase service. “You” means the person submitting an estimate or seller request. By browsing the website, submitting information, requesting a shipping label, shipping a device, or accepting a final offer, you agree to these Terms and our Privacy Policy.
Cashify’s legal operator, Canadian mailing address, and customer contact route are published before seller requests open. Seller requests are closed until they are.
You must be the age of majority in your province or territory, have legal capacity to enter into this agreement, and be the lawful owner of the device or authorized to sell it. If you are acting for a business or another person, you confirm you have authority to bind that party.
2. What Cashify does
Cashify provides a way to obtain an estimated value for certain used devices and, if both parties agree, sell an eligible device to Cashify. Cashify may accept or decline any seller request or device category where permitted by law. We may use service providers for hosting, communication, shipping, inspection, payment, and fraud prevention.
Cashify does not provide repair, data-recovery, financial, legal, insurance, or tax advice. The website’s estimates, explanations, and examples are informational and are not a binding offer to purchase, a guarantee of payment, or a promise that every device is eligible.
3. Estimates and final offers
Website estimates are shown in Canadian dollars and are based on the model, storage, condition, power, and lock status you provide. They are starting values only and are not binding. A final offer can differ when inspection identifies a material difference from those answers, including a different model or storage, damage, battery or power issues, repairs or missing parts, activation or carrier locks, financing status, suspected fraud, or an ownership concern. Market movement after an estimate may also affect a final offer where disclosed before shipment.
After inspection, Cashify may provide a final offer. A purchase is not completed solely because an estimate was displayed, a label was issued, or a device was shipped. A purchase contract is formed only when you accept the final offer and Cashify confirms acceptance or sends payment, subject to applicable law.
4. Your promises about a device
When you submit or ship a device, you represent and warrant that:
- you own it free and clear, or have express authority to sell it, and it is not stolen, lost, unlawfully obtained, subject to a lien, financed balance, lease, or security interest that prevents sale;
- the device is not carrier-locked, activation-locked, remotely managed, enrolled in an organization’s device-management program, or subject to an unpaid account or fraud flag, unless you clearly disclosed it and Cashify agreed in writing to consider it;
- the information, photos, model, condition, damage disclosures, and documents you provide are accurate and complete;
- the device does not contain illegal content, malware, dangerous materials, or any item other than the device and any specifically approved accessories; and
- you have complied with these Terms, carrier instructions, and applicable law.
Cashify may reject, hold, report, or return a device where reasonably necessary to investigate ownership, theft, fraud, safety, or legal compliance. We may cooperate with law enforcement and relevant rights holders where required or permitted by law.
5. Back up, erase, and unlock your device
Back up your data before shipping. You are responsible for removing personal information and disabling all locks and services, including Find My, Activation Lock, Google Factory Reset Protection, Samsung or other manufacturer accounts, eSIMs, physical SIM cards, enterprise management, and any carrier lock where applicable.
Cashify is not responsible for personal content, accounts, SIM cards, eSIMs, accessories, data loss, or loss of access to a device that you do not remove or back up before shipping, except where liability cannot be excluded under applicable law. After acceptance, Cashify erases the device using the manufacturer-supported process before it can be resold. Do not ship a device if you have not completed these steps.
6. Shipping, packing, and delivery
If Cashify approves your request to proceed, we may provide packing directions and a prepaid shipping label. Where the label includes carrier coverage, that coverage is subject to the carrier’s terms, declared-value limits, exclusions, and claim process; it is not a separate insurance policy issued to you and does not guarantee a purchase. A label is for the approved device and shipment only, is not transferable, and must not be used for prohibited, dangerous, or unrelated items.
You must package the device safely, follow the label and carrier instructions, and keep the drop-off receipt and tracking information. Carrier terms and service limits may apply.
Transit risk: Cashify bears the risk of loss or damage after the carrier accepts the correctly addressed, safely packaged device using our prepaid label and until delivery to Cashify. Keep the drop-off receipt and tracking details, and tell us within five business days of a delivery problem; we will open the carrier claim and keep you informed. You bear the risk before carrier acceptance and for loss caused by inadequate packaging, an incorrect address, or using a label for an unapproved shipment.
7. Inspection, final offer, and return
When a device arrives, we may inspect and test it to confirm identity, ownership status, specifications, functionality, cosmetic condition, battery health, parts, repair history, serial or IMEI status, activation status, and other eligibility factors. If inspection materially differs from your description or affects value, we may issue a revised final offer.
You may accept or decline the final offer. If you decline, Cashify will arrange return of the device in accordance with the instructions communicated to you, unless retention, reporting, or another action is required by law or reasonably necessary to investigate suspected theft, fraud, or a safety issue. Return timing may depend on carrier processing and verification steps.
If a device is reported lost or stolen, carrier-locked, activation-locked, remotely managed, or otherwise cannot lawfully be resold, we will not pay for or resell it. We will explain the finding where doing so will not compromise a fraud or law-enforcement inquiry, ask you to resolve the issue or arrange return, and retain or report it only when required by law or reasonably necessary to verify ownership, respond to a lawful request, or protect a person. We will not purchase it while the issue remains unresolved.
If we cannot reach you after a declined offer or a return request, we will send at least two written reminders using the contact details you gave us. We will hold the device for 90 days after the first reminder while we await return instructions. After that, we will give any further notice and take only the disposition permitted by applicable law; we will not treat an unclaimed device as sold or keep it as payment for storage.
8. Payment
After you accept a final offer and we complete any required verification, Cashify will arrange payment by Interac e-Transfer or another method we confirm with you. We do not promise a particular payout time. Banks, Interac participants, security reviews, incomplete information, weekends, holidays, carrier issues, and fraud checks may delay payment.
You are responsible for providing and maintaining an accurate email address and any payment information we reasonably request through an authorized channel. We may pause payment to correct an error, investigate fraud, comply with law, or resolve a dispute. Cashify does not ask for your banking password, one-time passcode, or Interac security answers by email.
9. Prohibited use and fraud
You must not use Cashify to misrepresent a device, conceal a lock or defect, sell a device you do not own, submit false photos or contact details, interfere with the website, introduce malware, scrape or copy the service at scale, evade security controls, impersonate another person, or violate any law. We may suspend or refuse service, cancel a request, retain evidence, and take other reasonable action in response to suspected misuse.
10. Privacy and electronic communications
Our Privacy Policy explains how we collect, use, protect, and disclose personal information and is incorporated into these Terms. By submitting a seller request, you consent to transactional messages about your estimate, label, shipping, inspection, return, payout, support, security, and legal notices.
Cashify will send marketing messages only as permitted by Canada’s Anti-Spam Legislation (CASL), including obtaining any required consent and providing an unsubscribe mechanism. Transactional or legally required messages may continue even if you opt out of marketing.
11. Service availability and intellectual property
We may change, suspend, or discontinue any part of the website, eligible device list, estimate methodology, or service where reasonably necessary. We do not guarantee uninterrupted, error-free, or secure access to the website. You should keep your own copies of information you submit and should not rely on the website as your sole record of a transaction.
The Cashify name, website content, visual design, pricing presentation, and other materials are owned by or licensed to Cashify and are protected by applicable intellectual-property laws. You may use the site for its intended personal or business selling purpose, but you may not copy, reproduce, modify, reverse engineer, or use its materials for a competing or unlawful purpose without permission, except where law permits.
Apple, Google, Samsung, iPhone, MacBook, Android, Interac, and related marks belong to their respective owners. Cashify is not affiliated with, endorsed by, or sponsored by Apple, Google, or Samsung.
12. Disclaimers, limited liability, and your responsibility
To the maximum extent permitted by applicable law, Cashify provides the website and estimates on an “as is” and “as available” basis. We do not warrant that a website estimate will match a final offer, that every device will be accepted, or that a carrier, bank, payment network, or third-party service will operate without delay or error.
While a device is in Cashify’s possession or control, from delivery until it is returned or a purchase is completed, Cashify holds it as bailee and will exercise reasonable care. We are responsible for direct loss of or physical damage to that device caused by our failure to meet that duty. The limitation below does not apply to that responsibility.
To the maximum extent permitted by law, Cashify will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss caused by information left on a device, third-party carrier or bank delays, or your inaccurate information, inadequate packaging, or breach of these Terms. This does not exclude liability for a device while in our custody as described above, fraud, intentional misconduct, gross negligence where it cannot be excluded, bodily injury, or any liability or consumer right that applicable law does not allow us to exclude or limit.
For a claim not excluded from the limitation above, Cashify’s aggregate liability is limited to the greater of the amount paid or payable to you for the specific device giving rise to the claim and CAD $100, except where applicable law requires a different result. You are responsible for direct losses, claims, or costs caused by your breach of these Terms, your unlawful sale of a device, or your intentional misrepresentation, subject to applicable law.
13. Consumer rights, applicable law, and disputes
These Terms do not limit consumer-protection, privacy, warranty, cancellation, language, or other rights that cannot legally be waived. If a provision conflicts with mandatory law in your province or territory, that law prevails and the rest of the Terms will remain effective to the extent possible.
For consumers, these Terms and any dispute are governed by the laws applicable in the province or territory where you ordinarily reside and applicable federal laws of Canada, unless a different mandatory law applies. Courts or tribunals with jurisdiction under applicable law may hear a dispute. Before starting a formal claim, please contact Cashify so we can try to resolve the issue fairly.
Québec residents: where applicable, these Terms are subject to the Civil Code of Québec, the Consumer Protection Act, Québec privacy law, and any mandatory French-language or consumer rights. Nothing here is intended to waive a right available under Québec law.
14. Changes, severability, and contact
We may update these Terms when our service, pricing, shipping, payment, or legal obligations change. The current version and effective date appear at the top of this page. For a material change, we will give affected sellers at least 30 days’ advance written notice, describe the change and its effective date, and give a way to stop the affected sale before it takes effect. We will not apply a material change to an active seller request unless the seller re-confirms acceptance through the notice flow or applicable law permits otherwise.
If any part of these Terms is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. These Terms and the Privacy Policy are the entire agreement regarding your use of the website and the estimate-request process, unless a separate written purchase or shipping agreement applies to a completed sale.
